INFORMATION NOTICE REGARDING THE PROCESSING OF USERS’ PERSONAL DATA IN ACCORDANCE WITH ART. 13 AND 14 OF REGULATION (EU) 2016/679 (“GDPR”) – “CONTACT US”

Hereinafter also referred to individually as “Company” or “Controller” and jointly as “Joint Controllers”.

DATA PROTECTION OFFICER (DPO)
PERSONAL DATA PROCESSED

The Joint Controllers will process the data you directly provide by filling out the contact form; this only includes common personal data (such as name, surname and contact details). 

PURPOSE OF PROCESSING

Respond to inquiries submitted by data subjects about the Companies and/or their products and services.  

Fulfill obligations or exercise rights under national or European Union law. 

If necessary, to ascertain, exercise or defend the Controller’s rights in judicial or out-of-court procedures. 

LEGAL BASIS FOR PROCESSING

Execution of the contract to which the data subject is a party or execution of pre-contractual measures taken at the request of the data subject, pursuant to Art. 6.1(b) GDPR. 

Legitimate interest in the retention of data by the Joint Controllers (proper processing and follow-up of the request) pursuant to Article 6.1(f) GDPR. 

Fulfillment of legal obligations to which the company is subject, pursuant to Article 6.1(c) GDPR. 

Legitimate interest for common data pursuant to Article 6.1(f) GDPR. 

DATA RETENTION PERIOD

For the time required to process the request and thereafter for a period of 3 years. 

For 10 years, or for any further term required by law. 

For the entire duration of the litigation or extrajudicial proceedings, until the time limits for appeal are exhausted. 

Once the above-mentioned retention periods have expired, personal data will be destroyed, or anonymised, in line with the technical procedures for deletion and backup and with the accountability requirements of the Controller. 
PROVISION OF DATA

Data marked with an asterisk in the contact form are necessary to follow up on the data subject’s request; if the data are not provided, it will not be possible to fulfill the data subject’s request.  

Conversely, unmarked data are optional: failure to provide such data will not affect the possibility of proceeding with a response to the data subject’s request. 

SUBJECTS AUTHORISED TO PROCESS 

Personal data may be processed by the employees of the Company functions deputed to the pursuit of the aforementioned purposes, who have been expressly authorised to process the data and who have received adequate operating instructions pursuant to art. 29 of the GDPR and 2 quaterdecies of Legislative Decree 196/2003, as amended and adapted by Legislative Decree 101/2018. 

RECIPIENTS OF DATA 

The data may be communicated to entities acting as data controllers, including, in particular: 

a. Companies of the Group; 

b. Authorities and supervisory and control bodies (e.g. Agenzia delle Entrate, Guardia di Finanza). 

Data may be processed, on behalf of the Controller, by parties designated as data processors, including, but not limited to, companies that perform management and/or maintenance services for the Site.

TRANSFER OF PERSONAL DATA TO COUNTRIES OUTSIDE THE EU 

There are no data transfers outside the European Union. 

DATA SUBJECT’S RIGHTS - COMPLAINT TO THE SUPERVISORY AUTHORITY 

By contacting the Company at [email protected], or the DPO at [email protected], data subjects may: 

  • request access to the data concerning them, their rectification, integration or deletion, as well as the restriction of processing in the cases provided for by Article 18 GDPR; 
  • object to processing in cases of legitimate interest of the data controller; 
  • where processing is based on consent or contract and is carried out by automated means, receive the data in a structured, commonly used and machine-readable format and, if technically feasible, transmit them to another data controller without hindrance (‘right to data portability’); 
  • withdraw the consent given at any time; such withdrawal shall not affect the lawfulness of the processing based on the consent previously given. 

Data subjects also have the right to lodge a complaint with the competent supervisory authority (Italian Supervisory Authority).
